According to a recently published resolution of the Curia, real estate property purchased from money donated for the purpose of buying such property is reclaimable within five years. Reclaiming the gift is deemed a contract claim even if the object of the donor’s claim is the ownership title of the real property purchased from the money donated for the purpose of buying such property, thus, the donor is not only entitled to recover gifts of money but also to recover the replacement value of those, for example the real estate property purchased from cash gift.
